 Insufficient vSAN add-on license in VVF

Hi
We have a 2 nodes VSAN ESA cluster with one CPU 16 cores INTEL  XEON GOLD 6526Y each node.
We have VMware ESXi 8.0.3 build-24022510 and vCenter Server 8.0.3 build-24091160 installed
VSAN ESA Storage size is 11.64 TiB, composed by 4 NVMe Drives Micron 7450 MTFDKCC1T6TFS (1600GB ESXi  detect 1.45 TB ) each node.
vSphere infrastructure is licensed under vSphere Foundation licenses for 32 cores.
We don’t understand why the system ask for a 14TB vSAN License and won’t accept our 12TB License.

This isn’t part of a VXRail Deployment.

Several days ago we opened two tickets: 

one to the licensing team which was closed stating that it is not a licensing issue.
And a technical one that has not yet given any response. 

I  also would like to know what can happen to a vSAN ESA cluster in production with the active alarm “vSAN Cluster Claimed Capacity Exceeds Entitlement”
